Voting Question: Am I legally obligated to pay a brokerage fee?
Approximately a month ago I was looking at a car through a dealership, and the dealer explained that they have a finance person through the car yard who would be able to organise a loan on my behalf. When discussing the matter with the broker he seemed to think that he should have an answer about finance by the next day. Unfortunately the process was quite a bit longer than that, taking up to 3 and a half weeks and not without me basically seeking out a loan myself. Had I not followed up with a bank he sent applications into, my application would not have gone through. In fact it was initially refused, and I had to prompt the broker to send in the correct information needed by the bank. I then ended up personally dealing with the bank myself, as he was not able to provide them with the information that they needed when they needed it. I also found it difficult to contact him, and the whole process was quite stressful for me. The other day the broker called me inquiring about the progress of my application. I explained that the loan had been approved, and all that needs to be done now is just signing of the contracts at the bank. I then made a comment about how I was somewhat confused about the amount of the loan that had been approved, as it was approximately $2000 more than the total drive away cost of the car that I was looking at. The broker stated that the bank would be sending out a check to him of $900 for the cost of the services that he provided, and there was some other insurance costs that the broker requested costing approximately $1300 which was added onto the total amount of my loan. I spoke to the bank that have approved my loan, and they stated that they can forward the money to him on my behalf, and this was what was organised in my application but as it is my loan they stated that it is up to me as to whether I wanted to do this. My issue is that I never agreed to pay the broker a fee, and I never signed any documents stating that I would pay the broker a set fee. It was never mentioned when I agreed for them to seek finance on my behalf, and it is only now that he has mentioned it. He is also wanting money for some type of insurance, but it is not comprehensive
car insurance and he hasn't even sent me any documents explaining what this covers. What I would like to know is if I am legally obligated to pay the fees, even though I wasn't told about it until now. I find the prospect of this even more annoying considering the fact that he was essentially hopeless at doing the job that he is wanting me to pay for. The only document I have signed is a privacy act form giving the broker the ability to give and receive personal information about me to potential lenders. There is nothing in this form about fees for services, and as far as the bank is concerned they are quite happy to give me the full amount including the $2000 he is wanting for services. He has requested this money but the person I have been dealing with at the bank stated that they need my permission to send him any money, and the decision is up to me.
